What is a Living Will?
A living will is a document that allows clients to dictate specific health care wishes if they are unable to make decisions themselves. This document attempts to anticipate possible medical circumstances and outlines what medical treatments the client would want administered or withheld under those circumstances.
The living will is intended to as an empowerment for our healthcare proxy so that they have the power and the ability to make a difficult decision as to our life prolonging procedures. While the hypocritic oath is to keep people alive indefinitely, the living will is a document that speaks to our unique wishes when it comes to our life prolonging options. You may wish to speak to your health care provider or Elder Law Attorney to be certain you have completed the will to ensure that your wishes are clear and will be understood.
Living Will vs. Last Will and Testament
Living wills are different from a last will and testament in two ways:
- Living wills take effect while the client is alive, but a last will takes effect after the client has passed.
- Living wills manage healthcare decisions, while a last will dictates how the decedent’s assets will be distributed.
